The book tries to reconstruct how Islamic legal thought (fiqh / jurisprudence) could be understood, re-evaluated and possibly reformed in light of comparison with Western legal systems, especially where colonial rule (i.e. British rule in South Asia) had intervened and “suspended” or modified Islamic laws. The author wants to provide terminology, structure, conceptual clarity so that Islamic law can respond to modern challenges, rather than being frozen in historical forms.
